Document 2: WO 0.2/33073 Al (Chugai Pharmaceutical Co.,

v The invention set forth in claims 1 to 14 does not
involve an inventive step in the light of documents 1 and
2 cited in the international search report.

Documents 1 and 2 set forth a modified antibody
having an L chain V domain and an H chain V domain which
forms the same antigen bonding domain as a new antibody
which effectively does not have a TPO agonist activity
and which bonds to a TPO receptor, as a modified antibody
having TPO agonist activity, and suggest that said
modified antibody includes antibodies having an agonist
effect (see document 1, page 5, lines 17 to 25; document
2, page 5, lines 6 to 15) .

Moreover, a modified antibody containing two or more
L chain V domains and two or more H chain V domains of a
new antibody such as sc(Fv) 2 was a known feature at the
priority date of this application (see, for example, J.
Immunol. Methods, 1999, Vol. 231 (No. 1-2), pages 177 to
189, WO 01/79494 Al, WO 01/66737 Al).

Box No. V Reasoned statement under A rtlde 35(2) with regard to novel ly, inventive step or industrial applicability;

stations and explanations supporting such statement

In the light of said suggestion of documents 1 and
2, it would be easy for a person skilled in the art to
conceive of measuring the bonding activity of sample
antibodies, selecting a new antibody having bonding
activity, using known genetic engineering techniques to
prepare modified antibodies having the pair of H chain V
domain and L chain V domain of said new antibodies,
measuring the agonist activity of said modified
antibodies, and selecting a modified antibody having
agonist activity.
